Terms and Conditions:

These terms ('Terms') apply to you when you:

  • reserve a vehicle through our reservation platform via https://www.volkswagen-vans.co.uk/en/Northern-IrelandOpens an external link('Site') or via Agnews Volkswagen Van Centre Mallusk website or Donnelly Volkswagen Van Centres Dungannon and Eglinton website; and
  • pay your reservation fee online, following which the payment will then be transferred to your preferred Volkswagen Van Centre ('Volkswagen Van Centre').

Please select your preferred Volkswagen Van Centre carefully.  Your reservation fee and reserved vehicle will be allocated to this Van Centre.   If you elect to change Van Centre, your reservation will be cancelled and you must request a refund of your reservation fee.  If you wish to reserve the vehicle with a new Van Centre, then you can start the reservation process again (to the extent the vehicle is available).

Please note that the reservation platform will show selected vehicles available from stock. If you cannot find the vehicle or specification that you are looking for, then please speak directly to your local Volkswagen Van Centre.

Please read these Terms carefully before you complete your reservation and pay your reservation fee.

These Terms tell you who we are, the details of our reservation platform, how to cancel your reservation and ask for a refund of your reservation fee and other important information. In particular, please read the terms relating to the limitations of our liability to you.  We recommend that you print or save a copy of these Terms for future reference.

When you reserve a vehicle through our reservation platform, you confirm that you accept and will comply with these Terms. If you do not accept these Terms, then you should not pay your reservation fee.

1. Who We Are

1.1 This reservation platform is operated by Volkswagen Commercial Vehicles, a trading division of Volkswagen Group United Kingdom Limited ('we', 'our' or 'us', as applicable). Our registered office address is at Yeomans Drive, Blakelands, Milton Keynes MK14 5AN. Our registered company number is 514809 and our VAT registration number is 217990930.

2. Reserving a vehicle

2.1 The Site includes a tool that allows you to search for your desired specification vehicle from vehicles that may be available on our Site.  If a vehicle meeting your specification is available, you will be able to pay your reservation fee online and reserve the vehicle.  This vehicle will then be reserved for you for a period of three days following the date you complete your reservation for that vehicle (the "Reservation Period").   Once your vehicle is reserved, it will not be hidden from the Site (such that is unable to be viewed by other customers), but a "Reserved" label will be applied to the listing within 24 hours of your reservation. In the event another customer tries to reserve your vehicle within this 24 hour window, they will be asked to reserve a different vehicle or order a vehicle from the Volkswagen Commercial Vehicles' factory. The vehicle you have reserved will be removed from the Site once you finalise your order with your chosen Volkswagen Van Centre. 

2.2 Please note that the display of vehicles and search results on the Site, and your use of the tool to reserve a vehicle and pay your reservation fee is not an order to purchase and/or a contractual sale of the vehicle that has been reserved. You will need to place an order to purchase the vehicle with your chosen Volkswagen Van Centre within the Reservation Period. Your chosen Volkswagen Van Centre will either contact you on the day and timeslot you have selected on the Site for a call (subject to their availability) or wait for you to attend your scheduled appointment to progress your purchase.  If your chosen Volkswagen Van Centre is not able to contact you on the date and timeslot you have selected, they will endeavour to contact you as soon as they reasonably can after that time.

2.3 The sale agreement for any vehicle reserved is not concluded on the Site and you will need to visit the applicable Volkswagen Van Centre to make your purchase.  If you decide to purchase the reserved vehicle, the agreement for the purchase of the vehicle will be between you and the applicable Volkswagen Van Centre. We (Volkswagen Group United Kingdom Limited) do not enter into these agreements and, as we are not a party to them, do not have any obligations under them.

2.4 Please see section 7 below for more information on the ordering process for the reserved vehicle.

2.5 Customers who use our reservation platform and pay a reservation fee to secure access to reserve their vehicle under these Terms are referred to as 'Customers' in these Terms.

2.6 While we endeavour to ensure that information is accurate on the website, it is always possible that errors may occur. VED and VAT rates may change from time to time and this may affect pricing. Prices are otherwise subject to change at any time. Always confirm prices and specification with your chosen Volkswagen Van Centre prior to ordering. We cannot (and Volkswagen Van Centres cannot) accept responsibility for your reliance on information contained on the website.

2.7 If you pay your reservation fee and reserve a vehicle, then it is your responsibility to place an order for the vehicle with your chosen Volkswagen Van Centre during the Reservation Period.

3. Eligibility

3.1 Consumers and/or traders aged 18+ who are resident in Northern Ireland and who reserve a vehicle using the Site and pay a reservation fee are eligible to participate in the reservation platform under these Terms. 

3.2 Reservations are non-transferable. The individual or business that paid the reservation fee must be the individual or business who places an order for the vehicle, enters into the purchase agreement with the Volkswagen Van Centre and ultimately takes ownership of the vehicle for personal or business use.  Fleet customers (limited companies and other businesses with five or more vehicles) are not eligible to participate in the reservation platform.

3.3 Only one (1) vehicle can be reserved at a time through the Site.

3.4 You agree not to use the reservation platform or any features on the Site for any re-sale purposes. Reservations deemed to be made with the intent to re-sell will be refunded and the reservation will be void.

4. Reservation fee

4.1 A reservation fee payment of £250 is required to reserve your vehicle.  Your reservation is not complete until you have paid the reservation fee.  

4.2 If you go on to order the vehicle in the Reservation Period then the full reservation fee payment will be deducted from the final purchase price payable by you under the purchase agreement with your Volkswagen Van Centre (see section 7 below).

4.3 If you do not go on to purchase the reserved vehicle (or purchase a vehicle after the Reservation Period), your reserved vehicle may be relisted on the Site and your reservation fee payment will be refunded in full to you in accordance with section 6 below. You can also request a refund of your reservation fee payment at any time before entering into a binding purchase agreement with a Volkswagen Van Centre for the reserved vehicle – see section 6 below.

4.4 Reservation fees can be paid in person with your chosen Volkswagen Van Centre (in which case the Volkswagen Van Centre will reserve your vehicle on your behalf) or online (via the Site), in which case payment will be transferred directly to your chosen Volkswagen Van Centre. Upon payment of your reservation fee online you will receive email confirmation of payment.

5. Your reservation

5.1 The Site includes a tool that allows you to search for your desired specification from vehicles that may be available from our ring-fenced inventory.  If a vehicle meeting your specification is available, you will be able to pay your reservation fee online and reserve the vehicle.

5.2 Payment of your reservation fee secures your desired vehicle for the Reservation Period.  The following steps have to be taken before your reservation is confirmed:

(a)     Applying. Visit the Site and complete your reservation with your personal details, selected retailer and other information requested on the form and press the "Reserve now" button;  

(b)     Payment of the reservation fee.  Payment of your reservation fee must be completed on the Site.  The payment will be transferred to the Volkswagen Van Centre you selected as your preferred retailer as part of the reservation process.

(c) Acknowledgement of your reservation. Once you have paid your reservation fee you will receive email acknowledgement (to the email address provided) that your reservation has been confirmed along with details of the vehicle specification that you have reserved.  

5.3 If we cannot grant you access to the reservation platform. If we are unable to grant you access to the reservation platform; for example, but without limitation, if your payment is declined by the card provider; the Volkswagen Van Centre is unable to process the transaction or the funds for your reservation fee do not clear; the reservation platform is temporarily unavailable; or this platform has been cancelled; your Volkswagen Van Centre will inform you of this by email.

6. Reservation fee Refunds

6.1 You can cancel your reservation and request a refund of your reservation fee at any time prior to any subsequent binding order for the purchase of a reserved vehicle. Please contact your selected Volkswagen Van Centre directly and request a refund.

6.2 A refunded reservation fee ends all rights to the vehicle that you had reserved.

6.3 If you do not place your order with your chosen Volkswagen Van Centre within the Reservation Period, please contact your selected Volkswagen Van Centre directly and request a refund.

7. Vehicle Order and Purchase Agreement

7.1 If you have reserved a vehicle and paid a reservation fee under these Terms, then you will be able to place your order with a Volkswagen Van Centre for the vehicle you have reserved. Confirmation of your order for the vehicle will be when the final purchase agreement is signed.

7.2 To purchase the vehicle you have reserved, you will need either (a) to visit your chosen Volkswagen Van Centre (i.e. the retailer that you selected and paid your reservation fee to as part of the reservation process) to enter into the relevant agreement(s) or (b) to complete the purchase over the phone or email with the Volkswagen Van Centre (if and to the extent that they offer the chance to conclude agreements in this way). A representative of your chosen Volkswagen Van Centre will provide and discuss with you the terms of the contract for the purchase of the vehicle and, if you decide to proceed with the purchase, the contract will be entered into with the relevant Volkswagen Van Centre (and not with us).  It is exclusively up to the Volkswagen Van Centre to provide you with all the pre-contractual information about the vehicle.  Please address any queries or issues to the Volkswagen Van Centre.

7.3 In the unlikely event that the vehicle you reserve is different to that which you reserved, or if there is an error in the pricing or the price changes, then you will be notified of this and are free to amend your order or cancel your reservation. If you cancel your reservation, the Volkswagen Van Centre will refund your reservation fee.

7.4 Please note that we cannot apply your reservation fee to any order other than the vehicle that you reserved.

7.5 Lead times for vehicles that are ordered are currently expected to be between 2 – 12 weeks from the time the purchase is completed (subject to change at our sole discretion). Time of delivery may be impacted by different factors. Customers will be advised of likely lead times by the applicable Volkswagen Van Centre on placing their order for the vehicle. After placing an order for the vehicle, customers will be updated on progress by their Volkswagen Van Centre.

7.6 You must select your preferred Volkswagen Van Centre before completing the reservation and paying your reservation fee. The vehicle you have reserved will be allocated to the Volkswagen Van Centre that you selected and to whom your reservation fee was paid. If you elect to change retailers, your reservation will be lost and you must request a refund of your reservation fee.  

8. Termination of the reservation platform

8.1 We may close the reservation platform to new applicants for any reason at any time. We will endeavour to provide notice on the Site before closing access to the platform.

8.2 We may terminate the reservation platform at any time. In such circumstances, Volkswagen Van Centres will refund all reservation fees paid by the payment method and to the card or other instrument which was used to pay the reservation fee.

9 Changes to these Terms

9.1 We may change these Terms at any time by providing notice on the Site and by email to customers who have paid a reservation fee. You are advised to check regularly for any such notices. If you do not agree with such changes, you may cancel your reservation at any time and receive a refund of your reservation fee from the Volkswagen Van Centre in accordance with section 6 above.

10 Our Liability to You

10.1 We are under a legal duty to provide a reservation platform that conforms to the description on the Site and in these Terms. We will provide the reservation platform with reasonable skill and care.

10.2 We are responsible for foreseeable loss or damage caused by us. If we fail to comply with our obligations to you under these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into a contract on the basis of these Terms.

10.3 We are not liable for business losses. You agree not to use the reservation platform or any features on the Site, for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

10.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. We therefore do not in any way exclude or limit our liability under or in connection with any contract with you based on these Terms for:

10.4.1 death or personal injury caused by our negligence;

10.4.2 fraud or fraudulent misrepresentation;

10.4.3 any matter for which it would be illegal for us to exclude or attempt to exclude our liability.

11. Privacy Notice

11.1 Please refer to our Privacy Notice [Volkswagen Privacy Statement | VW Vans (volkswagen-vans.co.uk)Opens an external link] for information about how we will use your personal information in connection with the reservation platform and how it will be shared.

12. Other important terms

12.1 Site availability and terms of use. We try to make the Site and the reservation platform available at all times, but, of course, due to the inherent nature of online and internet based services, we cannot guarantee this. Your use of the Site is governed by the terms of use set out here: https://www.keyloop.co.uk/dealertech/assets/Terms-of-use.pdf.

12.2 Getting advice about your consumer rights. If you are a consumer, you have legal rights in relation to services that are not provided with reasonable skill and care or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

12.3 We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation within our group.

12.4 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these Terms to another person if we agree to this in writing.

12.5 If a court finds part of these Terms illegal, the rest will continue in force. Each of the sections of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining sections will remain in full force and effect.

12.6 Which laws apply to these Terms and where you may bring legal proceedings. These Terms are governed by the law of England and Wales and we and you can bring legal proceedings in the English courts. Nothing in this section 12.6 shall deprive you of the right to bring or defend proceedings in your home state nor of the protection afforded to you by the mandatory rules of law of the country in which you live. For example, residents of Northern Ireland can bring legal proceedings in either the Northern Irish or English courts.

12.7 Reliance on these Terms. We intend to rely on these written Terms and any document expressly referred to in them in relation to their subject matter. We and you will be legally bound by these Terms.

12.8 We are not responsible for delays outside our control. If we are prevented or delayed from complying with our obligations under these Terms by anything you (or anyone acting on your behalf) does or fails to do, or as a result of events or circumstances beyond our reasonable control, our inability or delay in performing our obligations will not be deemed to be in breach of contract.

12.9 References to 'including' and other similar expressions. In these Terms, words that appear after the expression 'include', 'including', 'other', 'for example', 'such as' or 'in particular' (or any similar expression) will not limit the meaning of the words appearing before such expression.

12.10 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.

12.11 Waiver. If you breach these Terms and we choose to ignore your breach, or if we delay in taking steps against you, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.
